| HC stays CM's order to remove Saoner civic body member |

In an order here by Justice Vasanti Naik notice was issued to respondents including state chief minister in a case by one Tejsingh Saoji seeking relief against his alleged illegal removal from the post of Member of the Municipal Council, Saoner, on February 8 last.
Petitioner was removed from his post on the ground of assaulting some other Members of the civic body on 27 April 2011. The court in its order has also stayed operation of the impugned order, removing the petitioner from the membership till further order.
The chief minister reportedly passed the impugned order removing the petitioner from membership under section 42 of the Municipalities Act. Saoji was elected member for the second time in the year 2011. He was served with show cause notice on July 28, last year, for alleged assault on other members. A criminal case is pending against him in the court of Judicial Magistrate First Class.
The court has issued notice and stayed the impugned order after being satisfied that the petitioner has made out a prima facie case that he was not permitted to lead evidence in support of his defense.
Advocate Atul Chandurkar appeared for the petitioner. GP Nitin Sambre (state) and advocate Mahesh Dhatrak (Chief Officer, Saoner Municipal Council) represented the respondents.
