Arushi murder case: CBI opposes transfer of trial

The Central Bureau of Investigation (CBI) on Tuesday objected to the plea of the Talwar couple -Rajesh and Nupur Talwar - accused in the 2008 Aarushi and Hemraj double murder case, seeking transfer of trial from a local court at Ghaziabad to Delhi.
Stating that there was "some hidden motives" behind the filing of the plea, Additional Solicitor General Haren Raval, appearing for the CBI, today submitted that it can provide adequate security measures to the couple and sought further time to file a detailed response.
The Talwar couple had in its petition sought shifting of the trial from Ghaziabad to Delhi citing security concerns.
A bench of Justice BS Chauhan and Justice JS Khehar today after hearing the arguments directed the investigating agency to file its response within two days and adjourned the matter for further hearing on February 27.
Earlier the Supreme Court had sought response from the CBI on the plea of the couple within two weeks. The Court had also asked the CBI Court, hearing the double murder case, to allow adjournment in the case if sought by the couple.
The couple was to appear before the Ghaziabad Magistrate Court for criminal proceedings in the double murder case pursuant to an earlier order of the Supreme Court.
Aarushi, a fourteen year old girl, was found murdered at her house in Noida on 16 May 16 2008. The next morning, the body of Hemraj, the domestic helper, was found on the terrace.
The Uttar Pradesh police had initially carried out the investigation, and on 23 March 2008 arrested Rajesh Talwar. Subsequently on 29 May 2008, the investigation was handed over to CBI.
Later on 11 July 2008, Rajesh Talwar was granted bail by the Ghaziabad court.
The CBI investigating the case had in it closure report filed before the trial Court after over two-and-half years, acknowledged that there were gaps in the investigation and it had been unable to find any evidence against the Talwars
